Terms & Conditions for Eillance

These terms and conditions apply to the “Eillance” application, available for download on the Google Play Store and potentially other platforms (hereinafter referred to as the “Application”) for mobile devices, and its associated web version. The Application was created by Denis Miller under the associated developer’s account Eillance https://play.google.com/store/apps/dev?id=6747208631083759434 (hereinafter referred to as the “Service Provider”) as a service.
Upon downloading or using the Application, you automatically agree to the following terms. It is strongly advised that you thoroughly read and understand these terms before using the Application. Unauthorized copying or modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
The Service Provider is dedicated to ensuring that the Application is as useful and efficient as possible. As such, they reserve the right to make changes to the Application or to charge for its services, at any time and for any reason. We will never charge you for the Application or its services without making it very clear to you exactly what you’re paying for.
The Application facilitates the transmission of data (video/audio streams) that you initiate between your devices. It may locally store settings or temporary data necessary for its operation. The Service Provider does not store your video or audio streams. It is your responsibility to maintain the security of your phone/devices and access to the Application. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Application won’t work properly or at all. You are also responsible for ensuring the security of the network environment(s) in which you use the Application.
Third-Party Services
Please note that the Application utilizes third-party services that have their own Terms and Conditions. You should familiarize yourself with them.

Connectivity and Usage
You should be aware that there are certain things that the Service Provider will not take responsibility for. Certain functions of the Application will require an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but the Service Provider cannot take responsibility for the Application not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left. The quality and reliability of the video stream depend heavily on your devices’ capabilities, your network conditions (bandwidth, latency, stability) on both the sending and receiving ends, and the performance of any intermediary STUN/TURN servers.
If you’re using the Application outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Application, or other third-party charges. In using the Application, you’re accepting responsibility for any such charges, including roaming data charges if you use the Application outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the Application, please be aware that we assume that you have received permission from the bill payer for using the Application.
Along the same lines, the Service Provider cannot always take responsibility for the way you use the Application i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, the Service Provider cannot accept responsibility.
User Conduct and Responsibility
You agree to use the Application only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the Application. You are solely responsible for how you use the Application, including where you place your camera device, what content you stream, and ensuring your use complies with all applicable laws and regulations, including privacy laws regarding recording or monitoring individuals. The Service Provider accepts no liability for any misuse of the Application or any consequences arising from the content you choose to stream or how you deploy your devices.
Disclaimer of Liability
Regarding the Service Provider’s responsibility for your use of the Application, when you’re using the Application, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties (like network providers, STUN/TURN server operators, OS manufacturers) to provide services and information to us so that we can make the Application available to you. The Service Provider accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the Application, or due to network connectivity issues, device limitations, or failures of third-party services. Furthermore, the Service Provider accepts no liability for any privacy breaches, damages, or losses resulting from unauthorized access to your devices or network, or from your specific implementation and use of the Application.
Updates and Termination
At some point, we may wish to update the Application. The requirements for the operating system (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the Application. The Service Provider does not promise that it will always update the Application so that it is relevant to you and/or works with the specific OS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the Application, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the Application, and (if needed) delete it from your device.
Changes to These Terms and Conditions
The Service Provider may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page and updating the effective date. These changes are effective immediately after they are posted on this page.
